Speeding Tickets

ZERO POINTS ON YOUR LICENSE IS OUR GOAL

Most speeding tickets received in Southampton will end up at the Southampton Town court located at 32 Jackson Avenue in Hampton Bays. Speeding tickets received within Southampton Village will be returnable to the Southampton Village Court at 151 Windmill Road, Southampton.

While the ultimate outcome of your Southampton speeding ticket will depend on a variety of factors, the goal at the Law Office of Gary S. Miller is to have your speeding ticket dismissed or reduced to 0 points. We work hard to try to provide the best result possible, and are proud of our accomplishments, and the results that we have been able to provide to our clients.

The following are the number of points that to each speeding conviction carries:

  •  3 points ----- 1 to 10 mph over limit
  •  4 points ---- 11 to 20 mph over limit
  •  6 points ---- 21 to 30 mph over limit
  •  8 points ---- 31 to 40 mph over limit
  •  11 points ---- over 40 mph over limit

The following are some of the reasons you should not plead guilty to your Southampton Speeding Ticket.

Too many points will lead to a license suspension

You really do not want to be convicted of a speeding ticket if you can avoid it. All speeding tickets carry points, and in fact, most carry a lot of points. For example, a speeding ticket of 76 miles per hour in a 55 mile per hour zone carries 6 points. If you accumulate over 10 points on your license within an 18 month period, DMV will automatically suspend your license.

Three or more speeding tickets can lead to a 6 month suspension

If you are convicted of 3 speeding tickets with dates of violation within an 18 month period, NYS DMV will suspend your license for 6 months.

New York State Drivers Assessment fee

In New York, if you are convicted of a 6 point speeding ticket, the New York State DMV will impose a driver assessment fee. New York State Driver assessment fees start at $300 ( $100 per year for 3 years). The higher the points, the higher the assessment. An 8 point speeding conviction carries a $450 assessment fee ( $150 a year for 3 years). This is providing you have a clean license. If you already have points on your license that DMV is factoring in, the drivers assessment fee will be increased. The driver assessment fee is in addition to the fines and surcharges imposed by the court.

If you are convicted of 3 speeding tickets with dates of violation within an 18 month period, DMV will suspend your license for 6 months.

Increased Insurance Premiums

Speeding tickets are not looked upon favorably by insurance companies. In fact they are weighted heavier than most non-speeding tickets of the equivalent points. It is always best to try to avoid a speeding ticket being placed on your license.

Every day I walk into court and watch people plead guilty to speeding tickets that I know I could have had dismissed or at very least, reduced to 0 points. In fact, at the Southampton Town Court at 32 Jackson Avenue, everyday there is a line of people eager to pay their speeding tickets. Unfortunately, what they don’t realize is that they are paying more in fines, surcharges and driver assessment fees than had they hired my law firm to handle their case. At the end, not only did they spend more money, but they also ended up with points on their license that could have been avoided.  In addition, some of these people will ultimately have their licenses suspended as a result of paying their speeding ticket.
